Mediation

What is Mediation?
Mediation is a private and informal dispute resolution process where a neutral person (the mediator) helps the disputing parties discuss, organize and ultimately resolve their dispute. Mediators are experts in conflict resolution and have a variety of tools and techniques at their disposal to help parties in conflict with their dispute.

In Ohio, mediation is legally defined by the Uniform Mediation Act as:
“any process in which a mediator facilitates communication and negotiation between parties to assist them in reaching a voluntary agreement regarding their dispute”

How to Choose a Mediator:
The term “mediation” can mean different things to different people. After all, mediation is used to resolve a dizzying array of disputes ranging from neighbor/community disputes, to divorce cases, to complex litigation and even international political disputes. Exactly how the mediator helps the parties will vary from case to case and from mediator to mediator.

To ensure that you find a mediator who is the right fit for you and your dispute, we at Shaker Mediation Center encourage you to interview prospective mediators before starting the process. Ask them about their background and training. Ask about their mediation style. Are they facilitative, evaluative or even transformative? Do they value process expertise, subject matter expertise or both? For help in choosing the right mediator, feel free to contact Shaker Mediation Center. How Long Will it Take?
Just like no two mediators are the same, no two disputes are they same. Thus, mediations can range from a single short-session to a series of sessions over a period of months. Most simple business and contract disputes can be resolved in a session or two, whereas a complicated divorce and custody dispute will probably take at least several mediation sessions. If you have questions about how long the mediation of your specific dispute may take, please contact Shaker Mediation Center.

How Much Will it Cost?
Shaker Mediation Center charges parties on an hourly basis for mediation services. The cost is typically shared by the parties. Shaker Mediation Center offers free initial consultations, either in person or on the telephone. During that time, we will discuss your dispute and give you an indication of how long it may take and what your mediation may cost. On average, mediations are significantly less expensive than other forms of dispute resolution, including litigation, arbitration, collaborative divorce and even attorney negotiated settlements. Please contact Shaker Mediation Center with any questions regarding mediation fees and costs.
